Information on the collection of personal data pursuant to Articles 13 and of Regulation (EU) 2016/679 (GDPR)
Pursuant to Article 13 of Regulation (EU) 2016/679 (GDPR) with reference to the personal data intended for processing, the following information is provided:
1) Purposes of Processing
The processing to which personal data, which will be acquired and periodically updated, will be subjected, aims to fulfill the services requested from HTM Stampi S.R.L., specifically regarding the company’s core business (e.g., quote requests, contact for information, management of commercial and contractual relationships).
2) Nature of Data Provision
The provision of personal data is necessary to establish the contractual relationships mentioned in point 1) above. Any refusal to provide such data would make it impossible to manage these relationships, consequently preventing the establishment of the relationships themselves, whether they are employment contracts, other contracts, or authorizations within the competence of HTM Stampi S.R.L.
3) Methods of Processing and Retention
Processing will be carried out in an automated and/or manual form, using methods and tools that comply with the security measures set out in Article 32 of GDPR 2016/679, by specially appointed individuals, in accordance with the provisions of Article 29 of GDPR 2016/679. Please note that, in compliance with the principles of lawfulness, purpose limitation, and data minimization, pursuant to Article 5 of GDPR 2016/679, the personal data retention period is set for a period not exceeding the achievement of the purposes for which they are collected and processed, and in compliance with the timeframes prescribed by Law.
4) Scope of Data Disclosure
Data will not be communicated to third parties, except as strictly necessary for the performance of services or the fulfillment of legal obligations.
5) Individuals Who May Become Aware of the Data
The Data Controller, Data Processors (if appointed), and Data Processors (authorized personnel), as well as those in charge of maintaining electronic processors and management software supplied to HTM Stampi S.R.L., may become aware of the data.
6) Data Controller and Data Processors
The Data Controller is HTM Stampi S.R.L., with registered office at VIA PASSERERA 2/C – 24060 – CHIUDUNO (BG), VAT Number 02757300161, Fiscal Code 02757300161.
Any Data Processors are distinguished by: internal personnel performing their activities and duties, external personnel performing configuration and maintenance activities for the Systems and Equipment used by HTM Stampi S.R.L., located at Via Passerera 2/C, 24060 Chiuduno (BG). The updated list of data processors, if appointed, is kept at the Controller’s headquarters.
7) Data Subject’s Rights (Articles 15 to 22 GDPR)
At any time, the data subject may exercise, pursuant to Articles 15 to 22 of the GDPR, the right to:
- Obtain confirmation as to whether or not personal data concerning them are being processed, even if not yet recorded, and to have such data made available to them in an intelligible form.
- Obtain indication and, if applicable, a copy of: a) the origin and category of personal data; b) the logic applied in case of processing carried out with the aid of electronic tools; c) the purposes and methods of processing; d) the identification details of the controller and processors; e) the entities or categories of entities to whom the personal data may be communicated or who may become aware of them, particularly if recipients are in third countries or international organizations; f) where possible, the period for which the personal data will be stored, or the criteria used to determine that period; g) the existence of automated decision-making, including profiling, and in such cases, the logic involved, and the significance and envisaged consequences for the data subject; h) the existence of appropriate safeguards where data is transferred to a third country or international organization.
- Obtain, without undue delay, the rectification of inaccurate personal data, or, taking into account the purposes of the processing, the completion of incomplete personal data.
- Withdraw consent to the processing of personal data at any time, easily, without impediments, using, if possible, the same channels used to provide it.
- Obtain the erasure, anonymization, or blocking of data: a) processed unlawfully; b) no longer necessary in relation to the purposes for which they were collected or subsequently processed; c) in case of withdrawal of consent on which the processing is based and where there is no other legal ground; d) where you have objected to the processing and there are no overriding legitimate grounds for the processing; e) in case of compliance with a legal obligation; f) in the case of data relating to minors. The Controller may refuse erasure only in cases of: a) exercise of the right to freedom of expression and information; b) compliance with a legal obligation, performance of a task carried out in the public interest or exercise of official authority; c) reasons of public health interest; d) archiving in the public interest, scientific or historical research purposes or statistical purposes; e) establishment, exercise or defense of legal claims.
- Obtain the restriction of processing in case of: a) contestation of the accuracy of the personal data; b) unlawful processing by the Controller to prevent its erasure; c) exercise of a right by you in judicial proceedings; d) verification of whether the legitimate grounds of the Controller override those of the data subject.
- Receive, where processing is carried out by automated means, without impediment and in a structured, commonly used and machine-readable format, the personal data concerning you, and to transmit those data to another controller or – if technically feasible – to obtain direct transmission from the Controller to another controller.
- Object, in whole or in part: a) on legitimate grounds, to the processing of personal data concerning them, even though they are relevant to the purpose of the collection; b) to the processing of personal data concerning them for the purpose of sending advertising material or direct sales or for carrying out market research or commercial communication, by means of automated calling systems without the intervention of an operator, by email and/or by traditional marketing methods by telephone and/or paper mail.
- Lodge a complaint with the Italian Data Protection Authority (Garante per la Protezione dei Dati Personali).
In the cases mentioned above, where necessary, the Controller will inform third parties to whom your personal data are communicated of your possible exercise of rights, with the exception of specific cases (e.g., when such fulfillment proves impossible or involves a disproportionate effort compared to the protected right).
